INDIANA RACING LAW LAWA LAW A long range idea of Gov Go Mathews of Indiana is full of color He is a politician Thats Hats sure Hes Hess forceful too But his methods are rough Bearing on Indiana racing they have gone to the extreme of persecution Evidently he has a grievance The public is entitled to a map of it The Indiana tracks are closed with a legal shutter which is to be clamped or taken down next Friday Racing never had a better chance in court than it has in the injunction case before Judge Gillette His spring ruling under which the Indiana tracks have existed was homely and commonsensible Broadly it was one of the best that can be re ¬ called as given that racing has ever had The decision of Judge McCabe of the Supreme Court which overruled the Gillette decision was worse than the average Its ruling reason was exactly against the facts Because the Indiana courses were close together because the same officials ruled all and because the same bookmakers did business at all Judge McCabe held that the Sellers law was violated What bosh Regularity of soil of operators and of fcifflcials who bave brave to deal with the same broad mass of racing material are beneficial to racing If these grounds are to be used for the basis of violation of the Sellers law the PercyGray Percy Jockey Club law of New York which has stood the test of three courts of progressive class each better than those of Indiana by general legal repute is also illegal The same condi condo ¬ tions ions rule under its provisons provisions The Sellers law is clear and plain It was made after ex ¬ perience prince and by less than a partial farmer It permits fortyfive fortified days racing per year between April 1 and November 1 within the state of Indiana the terms to be fif fief ¬ teen days each with thirty days interven intervene ¬ ing King between each term The Indiana tracks have kept the law well and turned more than half a million foreign dollars into a forlorn corner of a forlorn state The community about the tracks have appealed to Gov Go Mathews in behalf of their good thing Following his old line Mr Mathews seeks his own revenge and at the same time has enough leisure on hand to fight the American government over a land case Ergo The Mathews map of impetus is a public necessity
