HAVRE DE GRACE CASE GOES OVER Baltimore Md October 17 The case of the State of Maryland against the racetrack at Havre de Grace whicli was set for Tuesday last in the Court of Appeals will not come up till one week later having been imstponed in order to give the lawyers engaged in the case more time for prep ¬ aration arationThe The case is an appeal from the decision of Judge William U Harlan of Harford County who on an injunction proceeding tiled by the racetrack people lield that the validity of the law authorizing the racetrack was not at issue issueIt It is the hope of the State represented by Attor ¬ neyGeneral Edgar Allan Poo that the Court of Appeals will go into the whole question so that no further proceeding will be necessary It will be for the Court of Appeals to decide whether the law creating the Racing Commission of Harford County Is constitutional and also whether the members of tlie Racing Commission having failed to qualify within the constitutional limit of thirty days are authorized to act as such commission
