! I DEFENSE SCORES AT NORFOLK. Judge Designated By Governor Mann to Preside at Bookmakers Trial Is Without Jurisdiction Norf.dk. Va.. January 23. Magi Irate U. T. Towel! of Norfolk County will try the lour bookmakers who were arrested at the riose of the fall meeting of the Jamestown Jockey club on the charge of violating the antl-gamhling laws of :r gtaia. Judge .1. f. West of the Third Judicial District, who was designated by Governor Maun to preside at the trial of the bookmakers, sustained the contention ,,f the defease today thai the circuit court of Norfolk County was without concurrent jurisdiction in the- trial of the particular cases at issue. Judge West deplored the fact that the law-gave him no other alternative. Assistant Attorney -General Davis said that while he dill not believe that the state had an appeal. h« desired to reserve every point, and asked for time in which to Investigate the states right of appear: "I hope you can find that the state has a right of appeal, but 1 tear it has not." said Judge West. The case will be tried before .Magistrate Powell tomorrow.
