ARKANSAS DECISION GIVEN CIRCUIT COURT JUUGE REFUSES TO ISSUE MANDAMUS IN RACING BILL SUIT Decision Serves as Setback to Plans for Revival Racing at Hot Springs but Matter Is Likely to toGo Go io Supreme Court on Appeal Little Hock Ark April I Judge Guy Fnlk of the Pulaski Circuit court today denied tin petition for u writ of mandamus to compel the seretary of state lo publish as a law the Sawyer bill creating a state racing commissiiiu and legaliz ¬ ing parimntuel betting This settles the contro ¬ versy over the much discussed measure which Governor Hays was alleged to have first approved and then vetoed The decision if upheld in the supreme court of the state means that the Hot Springs business men who have been engaged in a determined effort to bring abmt the restoration of racing at Hot Springs will have to wail until the next session of the Arkansas legislature before making a fresh effort to accomplish their purpose1 It was announced when the present prxecdn s wcr instituted that in any event the matter would go to the highest court in the state for a linal de
