LOUISIANA RACING LAW Expert Legal Opinion Discounts Seriousness of the Ordinance NKW ORLEANS La May 30 While operators of handbooks were searching for legal opinions on Hie adoption last Wednesday by the Louisiana Con ¬ stitutional Convention of the ordinance to prevent the transmission publication or circulation of in ¬ formation on horses entered in races the attorneys of the two racing associations Friday struck an optimistic noto and believe that tho sport here will not lio affected when they are ready to resume operations next fall fallI I see nothing in the Breazoale ordinance said Walter Gleason attorney for the Business Mens IJacing Association which would create apprehen ¬ sion on the pnrt of persons engaged in the operation of n legitimate race track trackThe The Constitutional ordinance said Fred A Middleton attorney for the Jefferson Park Uacing Association is not conclusive and taken by itself means nothing nothingThe The legislature said Attorney Middleton must act to make the ordinance operative It is possible that the legislature may enact reasonable legislation on the subject The legislature may pass an act declaring it to be a violation of the law to make public any information on horses racing outside of the state stateWhile While Mr Middleton did not enlarge on this par ¬ ticular statement he was taken to mean that if the legislature enacted a law prohibiting the pub ¬ lication of information on horses racing outside of the state such a law would put the ban on hand ¬ books but would not interfere with the meetings of the Business Mens Kacirg Association nor the Jefferson Racing Association The provision that gambling is a vice and the legislature shall enact laws to suppress it said Mr Mid ¬ dleton has been in our constitution for sev ¬ eral years While the legislature has enacted laws to suppress some forms of gambling it has not enacted laws to suppress all forms of gambling gamblingIt It is possible that the legislature may enact a law that will prohibit the transmission and pub ¬ lication of information on horses outside of Louisi ¬ ana but will allow the publication of entries and results of races when the horses are racing in that state stateAll All of this of course is conjecture The legis ¬ lature on the other hand may enact a stringent law which will prohibit the transmission and pub ¬ lication of information irrespective of where the races are held heldKacing Kacing enthusiasts were firmly of the opinion that the Brcazcalc ordinance was aimed directly at Ihe handbook evil and not against the operation of the Business Mens Racing Association nor the Jefferson Kacing Associations winter meetings meetingsThe The TiniesPicayunc the only morning paper here attacks this ordinance in an editorial and says that It makes a threatening gesture at an evil while tending in effect to give it a new lease of life In our opinion says the Times the ordinance I is illjudged
