Tho Committee on Appeals has rendered tho following opinions, viz : "In the case of L. H. Ezell against the Harlem Jockey Club, we are of the opinion that Rule No. 26 was complied with. Tho rule does not contemplate that the complainant shall, in person, give notice within five days. Wo hold that ho may in person, by an attorney, or other authorized person, give the notice. In what more official way could he give notico than through tho Secretary of the Committee on Appeals? Hence the claim of the Harlem Jockey Club that Mr. Ezell could havo no standing before the committee is untenable. So far as these papers show the decision of the club that the raco was no contest is erroneous, and the purse should bo paid to the proper parties."
