1 1 1 TEST CASE DECIDED IN TEXAS. Austin. Tex.. May 20.— The State Court of Appeals vesterdav sustained the validity of the state law of IMS prohibiting lx-tting on horse races and the operation of poolrooms. It is held to be unlawful to bet on horse races in this state or place bets within llie state on races run in another state, or even foreign countries. In the case at bar the race was run at Juarez. Mex.. and the bet was made with a man iu Tulsa. Okla. It was in the ex | arte proceedings of Jack Walsh, seeking halieas corpus and who is ; remanded to the sheriff of Grayson County. Walsh, according to the allegations in the record, accepted *10 from Y. K. Allen and telegraphed same to one i U. L. Allison, at Tulsa, to be bet on Knight Deck, a i horse entered at Juarez. The application for habeas i-orpus was based on the eonletltion that the law-was unconstitutional. The court wrote M opinion of r itself, but adopted as its view an eluliorate brief of A-sistanl Attorney General John A. Mobley.
