TEST OF THE AGNEWPERKJNS LAW New York September rw A suit will be begun in a few days by the minority stockholders of the Wcstchcster Racing Association to call to account their directors for having failed to conduct the affairs of their property to the best advantage by not making use of the dates assigned them by the Jockey Club this fall for racing These dates were for twelve days racing from September 2G to October S The outcome of this suit will be awaited eagerly toy those interested in the welfare of the turf since a question will be raised as to the con ¬ stitutionality of the AgnewPerkiiis law The lawThe directors of the Westchester Racing Associa ¬ tion will make answer l y stating that under the clause of the AgnewPerkins bill which holds direct ¬ ors responsible Tor any illegal act committed on premises under their jurisdiction they were unable to conduct a race meeting without running the risk of a jail sentence since despite any or all precau ¬ tions which they might take there would in all likelihood toe found persons who would toet regard ¬ less of thi law lawIt It will then l o for the court to decide Can the directors toe held liable for the acts of others Is the section of the AgnewPerkins toill which holds they can be held liable constitutionally sound doc ¬ trine The Jockey Club despite public opinion to the contrary has not been inactive Its law ¬ yers have had the matter under advisement and have conceived this way out of the difficulty The case being a question of the constitutional right of prop ¬ erty owners which afJVcts the value of proper r is entitled to a speedy hearing before the Court of Appeals to which it eventually will be referred and a decision is expected before the winter is far advanced
