REFUSES A TEMPORARY INJUNCTION Juuge McMahon Will Not Hear Case Against Indiana I Track Until Next Thursday AttorneyGeneral Honans application for an In ¬ junction to restrain the Mineral Springs Jockey Club from proceeding with its meeting at Porter Ind will not be heard by Fudge McMahon in whose court sit Valparaiso the suit was filed until the judge re ¬ turns trom a vacation trip on which he departed a few days ago according to reports received from Porter yesterday When the suit was instituted Judge McMahon refused to grant the temporary in ¬ junction desired by the attorney general and ar ¬ ranged to take up the complaint on its merits on Thursday of next week or as soon thereafter as the condition of his calendar will permit Meanwhile tlie meeting of the Mineral Springs Jockey Club will have begun on Wednesday The officials of thc new racing organization continue to be serenely confident that the move of the attorneygeneral which was taken at the behest of Governor Marshall will come lo naught Upon naughtUpon the arrival this morning of two carloads of horses from Canada that were delayed en route at Detroit there will be just lt 7 horses at the new course available to fill the opening day card on Wednesday next The horsemen who are already unaltered at the track have l een in a position to see the difficulties with which the track builders have had to contend since the rains began a few days ago and are taking the postponement of th opening with good pace In fact several well known owners are lending what practical assistance thev can in getting the course itself in proper eond lion for the opening of the meeting The track is still a trifle soft in spots but is being worked into condition as rapidly as possible under the circum ¬ stances stancesKarl Karl Llnncll has shipped Black Mate Iovo Day and Kitty W fom Louisville to the Porter Ind track and n R Bradley has sent Buss Baldoyle and Bachelor Girl there in charge of trainer William Hurley
