SUES BRIGHTON BEACH ASSOCIATION New York May 12 A suit by tlie Jockey Club against the Brighton Beach Itacing Association to recover 2003 on a demand note executed in 1010 came to light in the Supreme Court when Justice Pcndleton denied a motion by the defendant to va ¬ cate the service of ivapors on Warren L Neu as treasurer of the association associationVictor Victor W Cutting counsel for the Jockey Club said that after the papers bad been served on Wil ¬ liam A Engoman president of the Brighton Beach Association Kngemau pleaded that tlie action be not pressed because lie was trying to arrange for the payment of the Brighton Beach clubs indebtedness He failed to make payment and the i aixrs were served on Neu Four days afterward Etigemaii told Lawyer Cutting it is alleged that unless the pai ors were withdrawn he would advise the clubs other creditors of the action and tlie association will be thrown into bankruptcy and result in wiping out the equity of the Brighton Boaeh Association and inci ¬ dentally myselfThe wiping out myself The defendant asked to have the service of papers on Neu vacated on the ground that he had resigned as treasurer two days before the papers were served but the process server said that Neu told him afte ward that he believed his resignation had been ac ¬ cepted because the papers bad been served on him and for no other reason
