H D BROWN WITHDRAWS HIS SUIT New York August 14 Judge Lacombe sitting in the Federal District Court yesterday signed an order discontinuing the Injunction suit brought by the Marvland State Fair which has a race course at Laurel Md against the Jockey Club its affiliated organization the National Steeplechase and Hunt Association August Belmont Frank K Rturgls Harry K Knapp Francis It Hitchcock Scliuyler L Parsons Andrew Miller James B Haggin and Perry Belmont as officers and stewards of the Jockey Club The discontinuance of the suit was consented to by Grant C Fox counsel for the complainant cor poration and Charles H Tuttle representing tlie defendants The Injunction was sought for the purpose of restraining the Jockey Club and the other defendants from exercising any control over horse racing outside the state of New York The first application was denied by Judge Ward for the reason that the Maryland State Fair had not paid one per cent of Its receipts for the meeting of Oc ¬ tober 1912 to the Jockey Club as the latters rules require So as to comply with the require ¬ ment the Maryland State Fair made the one per cent payment before renewing the application for the restraining order It is understood that the suit has been discontinued as the result of a satlcfactory agreement regarding the October meeting at Laurel being reached between the Maryland State Fair and the Jockey Club
