Wilkin has a suit against William P. Scully In which he for a court order directing the dissolution of alleged iiartnershlp existing between the men. p alntltl claims that he and the defendant entered into an agreement whereby he was to pav to defendant and that three race horses, known as Claxonette, Molnm and Intermediate. to be purchased; that from the proceeds or earnings of the horses at the various race tracks in the country the expenses should be deducted and the balance equally divided. This the plaintiff claims the defendant did not do and asks an attachment Issue against the horses Claxonette Molina, that they may be sold and a distribution of the funds made as the court mav direct.
