DECISION AFFECTING SELLING RACES RACESNow Now York February 1 A decision was handed down Saturday by Justice Cohalau of the Supreme Court which will interest racing men who have been the victims of unfair dealing In selling races The case ruled ou was tried originally in St Louis Granvllle Ieighty brought suit hi the Supreme Court to collect a judgment of S5 which was obtained in tlie Circuit Court of Missouri against Nimrod B Tiehonor The facts as cited were In August 1903 the plaintiff entered the horse Macbeth in a selling race at the Kinloch Jockey Club track St Louis In the san race the defendant had entered a uirse called lied cor and after tho race Tichcnor claimed Macbeth f i25 the entered prize oftlOO and 225 irio moi y yAfter After Tithonor I d taken the horse away Loighty Ion hied that there ad bfoii a conspiracy on the part C Evans J lies I llothwcll and George W Hazard to get possession of his horse and that for his part In elahping Macbeth Tichenor had received SIOO Leighty sued to set aside the forced sale of the horse and fo collect the winnings of Macbeth after he was taken from his stable The horse had won between four and five thousand dollars and loighty got judgment for all ho had won and tho right to take ho horse back by paying the original riirchMso price of 23 was unable to collect In InMissouri 1 Missouri but the firming decision of Justice Co Cohaliin haliin will enable him to collect hi this stale of which Tichenor is a resident 1
