THOSE WHO HUNT MUST KNOW LAW Hunters Are Cautioned to Note the Dates of Open Seasons Under Federal and State Xaws Washington D C October 22 In making their jilans to shoot migratory waterfowl hunters will do well to note the dates of open seasons under lK th federal and state laws This caution by the United States Department of Agriculture results from evidence of confusion in the minds of some sportsmen iu regard to the opening of the season when the dates conflict under state and federal laws lawsThe The federal law and regulations limit the seasons before and after which no one may shoot these birds If a state law opens the season later or closes it earlier than the dates prescribed by the federal regulations the season in that state is just to much further shortened Special attention is called to the fact that the federal regulations do not authorize anyone to hunt or kill migratory birds contrary to the state law lawIN IN ILLINOIS FOR EXAMPLE EXAMPLEIn In certain states as for example Illinois In ¬ diana Iowa Kansas Kentucky Missouri and South Dakota the season for shooting migratory xater fowl under the state laxv xvould open prior to the date of opening under the federal regulations were it not for the fact that the federal regulations su pcrcede state laxvs iu such case of conflict and prescribe for these states September 16 as the beginning of the oi en season Under the migratory bird treaty act regulations it is lawful to hunt waterfowl except xvood ducks cider ducks and sxvans for which there is no open season rails coot galliuules Wilson snipe or jacksnipe blackbellied and golden plovers yellowlegs woodcock and mourning or xvhitewinged doves during the open seasons prescribed by the regulations The several states hoxvever are au ¬ thorized under the treaty act still further to pro ¬ tect migratory birds birdsSALE SALE PROHIBITED PROHIBITEDUnder Under the treaty act and regulations the sale of all migratory birds other than propagated wa ¬ terfowl is prohibited throughout the United States except for scientific or propagating purposes Maxi ¬ mum bag limits arc also prescribed and when permitted by state laxv txvo days limit of migra ¬ tory birds may be shipped or transported from one state to another iu a calendar week Hunters are especially advised to familiarize themselves with the provisions of the new act and regulations copies of xvhidi or other information concerning which may bo had by communicating with the bureau of biological survey United States Department of Agriculture Washington D C The organization of the department for enforcing the provisions of the nexv laxv is practically com ¬ pleted throughout the country and the act grants the necessary police poxvers for its proper enforce ¬ ment The maximum penalties prescribed for vio ¬ lation of the proxisions of the new act are 500 fine or six mouths imprisonment or both
