MOBILE BETTING IS LAWFUL Judge Clark Upholds His Decision of Last Year in a Sim ¬ ilar Case MOBILE Ala March 2 The sections of the state code under which twentytwo men were arrested at the Fair Grounds here charged with violation of sections 7000 and 7003 which prohibits the selling of pools or making or taking a wager upon a prize light drill baseball or other contests were promptly discharged Saturday morning by judge Norborne N Clark in the inferior criminal court courtJudge Judge Clark in making his decision handed down the following opinion opinionWhen When charges were made before me last year against bookmakers for taking bets on horse races I went into the question as to whether the offense was within the prohibi ¬ tion of section 7000 cf the code of Alabama as amended September 30 1919 and was of tlie opinion then the ofCense as set forth in agreed statement of facts was not within the prohibition of said act actI I have again reviewed the acts and de ¬ cisions of our supreme court and my opinion has not changed changedSection Section 7000 of the code title is selling pools on events outside the state the title of the act amendatory thereof is selling pools or making or taking a wager upon a prize light drill baseball or other contest The amend ¬ atory act therefore seems to be an enlarge ¬ ment of the subject set forth in section 7000 of the cede cedeMy My opinion that the amendatory act has reference to direct wagers on prize fights drills or baseball contests and is only ap ¬ plicable to wagers on horse racing where wagers are through the medium of agents The agreed state of facts do not disclose a state of facts where wagers are made through agents but do disclose facts where wagers are direct and personal personalOn On this account the said amendatory act does not seem to apply
