TEXT OF THE LAWS THAT DEO THE MISCHIEF Severe Lines Upon Which the New York Measures Are Built The main feature of the new antibetting laws of New York is the extraordinary severity of the pen ally imposed on those convicted of making or in any way contributing to the making ot a bet At common law It Is no offense to make a wager and it is only through statutory enactment that it be ¬ comes so Generally speaking where betting is for ¬ bidden by law the penalties are mild with large discretion invested in judges But now in New York under the Draconian severity of the new laws one convicted of violating their provisions must go to prison There is no alternative The essential features of what are known as the AgncwHart laws are these theseAct Act No 212 introduced In the senate by Mr Hart January 15 is an act to amend the penal code relating to pool selling bookmaklng bets and wa ¬ gers It is as follows followsSection Section 1 Section 151 of the penal code as amended by Chapter G3G of the laws of 1901 is hereby amended to read as follows followsPool Pool selling bookmaking bets and wagers etc Ally person who engages in pool selling or book makiiig at any time or place or any person who keeps or occupies an room shed tenement tent booth or building float or vessel or any part there ¬ of or who occupies any place or stand of any kind upon any public or private grounds within this state with books papers apparatus or paraphernalia for the purpose of recording or registering bets or wa ¬ gers or of selling pools and any person who record or registers bets or wagers or sells pools upon the result of any trial or contest of skill speed or power of endurance of man or beast or upon the result of any political nomination appointment or election or upon the result of any lot chance causality unknown or contingent event whatsoever or any person who receives registers records or forwards iu any manner whatsoever any money thing or consideration of value bet or wagered or offered for the purpose of being bet or wagered by or for any other person or sells pools upon any such result or any person who being the owner lessee or occupant of any room shed tenement tent booth or building float or vessel or any part thereof or of any ground within this state know ¬ ingly permits the same to lie used or occupied for any of these purposes or therein keeps exhibits or employs any device or apparatus for the purpose of reckoning or registering such bets or wagers or the soiling of such pools or becomes the cus ¬ todian or depositary for gain hire or reward of any money property or thing of value stake wager or pledge or to be wagered or pledged upon any such result or any person who aids assists or abets in any such manner In any of the said acts whlei urc hereby forbidden is guilty of a misdemeanor and upon conviction is punishable by imprisonment In the penitentiiary or county jail for a pcrior of not more than one year immediatelyAct This yearThis act shall take effect immediately Act No 213 introduced by Sir Hart January 15 is an act to amend the act for the Incorporation of associations for the improvement of horses and t establish a State Racing Commission It is as follows followsSection Section 1 Section 1C of chapter 570 of the laws of 1S95 entitled An act for the incorporation of associations for the improvement of the breed of horses and to regulate the same and to establish a state racing commission is hereby amended to read as follows followsAll All racing or trials of speed between horses or other animals for any bet stake or reward except such as allowed by this act or by special laws is a public nuisance and every person acting or aiding therein or making or being interested in such bet stake or reward is guilty of a misdemeanor and upon conviction is punishable by imprisonment in the county jail or penitentiary for a period of not more than one year and iu addition to the pen ¬ alty prescribed therefor he forfeits to the people of this state all title or interest in any animal used with his privity in such race or trial of speed and iu any sum of money or other proiwrty betted or staked upon the result thereof thereofSection Section 17 of chapter 570 of the laws of 1S95 is hereby repealecjSection repealecj Section IS of such act as amended by chapter 3SO of the laws of 1S9C and chapter 44G of the laws of 1S97 is hereby amended to read as follows followsA A corporation or associati9n authorized by or entitled to the benefits of this act conducting a running or trotting or steeplechase meeting shall have the right to charge Increased or additional fees for admission to any special portion or portion of the grounds of such corporations or association unless such poolselling or bookmaklng as is punish ¬ able by fine or imprisonment or other acts so pun ¬ ishable to be thereon authorized or knowingly per ¬ mitted mittedThis This act shall take effect immediately
