HARTAGKEW LAW CASE Albany N Y December 19 The case of Charles Alberts who was convicted of gambling on evidence of having bookmaking slips in bis possession was presented to the Court of Appeals here today todayThis This is an appeal fiom a judgment of the Erie County Court convicting the defendant of violation of the Hart Ague w law for which he was sentenced to pay a fine of 500 The appellate division fourth department sustained the conviction Alberts was arrested at a desk iri a saloon neither of VThich was he the owner and the evidence against liim consisted of the slips of paper found in the desk containing the registry of bets oii the races Tlie defense was that tlie trial court committed an error in admitting them as evidence without proof that they were written by him The case was sub ¬ mitted to tlie court without argument
