BR0WNE-P0TTEE LITIGATION COMPROMISED. New York, May 24. — The differences Which existed between Grant Hugh Browne, owner of the Brown-leigh Park Stable, and Bobert II. MeCarter Poller, owner of the Pequeet Stad, have been settled amicably. Six years ago Mr. Poller sold Royal Stag and another stallion, together with a dozen broodmares, to Mr. Browne tor 2,300. Mr. Browne paid ,500, after looking over the breeding of the collection. Several days later the liorses were shipped 1 1-mi Mr. Potters establishment in Sussex County. N. J., to the stud that Mr. Browne was forming al Goshen, Orange County. N. Y. The thoroughbreds -lid not come up lo .Mr. Brownes idea of what thev shouid be wlen they arrived at Goshen. lb- Informed Mr. Potter what he thought of the conformation and condition of the horses and further stated that the deal would he off as far as be was concerned. The result was a law suit. Mr. Poller suing for 0,000. The case was tried before a .jury In February, 1907. at Goshen. Mr. Potter was awarded a verdict. The case did not end there, for Mr. Browne carried the mailer to the Court of Appeal-, which body granted a new trial. This new trial was due to be placed on the calendar recently, tint to avoid further litigation an agreement has been reached by which Mr. Browne pas Mr. Potter 1911.sh,090 in settlement of Ilis claim.
