MINERAL SPRINGS MANAGEMENT APPLIES FOR AN INJUNCTION A alparaiso Ind October 23 An application for issuance of an injunction to restrain Governor Marshall of Indiana his secretary Mark Thistlv waite and sundry other iwrsons hicluding the officers and men of the Indiana National Guard from further interference w li the conduct of racing over the track of the Mineral Springs Jockey Club near Porter Ind was made to Judge McMahon of the Circuit Court today in behalf of the incorporators of that organization When the jiersons concerned met before hint at the hour appointed by him Judge McMahon announced that because of his relationship to one or more of the applicants he would transfer the case to Judge Tuthlll and appoint its hearing to take place Iwfore the latter at 9 a in tomorrow In his office at Michigan City ind Notice to that effect and an order to l e present was directed to lie served on Assistant AttorueyrGeneral Brannamaii QuartermasterGeneral Garriird and the officers in command of the two companies of militia quartered at the Mineral Springs truck It was intimated that refusal or neglect to obey the orders of the court would subject the offenders to punishment punishmentThe The entries for Wednesday were declared off at the track and entries made and closed for the races set for today the lists appearing elsewhere As on the day before the militia maintained strict control of the grandstand and its approaches and were as unnecessarily rigid in making the owners and other people legitimately nt the track uncom ¬ fortable Owners having business at tho secretarys office could only gain access at the end of much argument and then found It difficult to get out again againMeantime Meantime in the hope that relief from the present annoying conditions will be given by the Indiana courts and racing resumed all hands at the track are awaiting such action as patiently as could be expected If todays races cannot be run off new entries will be made for Friday
