HAWTHORN POSITIVELY OUT OF DERBY His Owner Makes Definite Announcement of His f Plans Ten Point at Work Lexington Ky May l Owner C F Husehe meyer announced positively today that Hawthorn would not be a starter in the Kentucky Derby on Saturday next It would be bad policy to give the horse a rush preparation ii the limited time n terveiiing before the running of the race and like wise might prove injurious said Mr Puschemeyer It is the intention to give Hawthorn every chance to recover fully before again putting him in active training I beliey that he will be in good shape to lill his engagement in the Kentucky Handicap and he may be a starter during the closing days of the Churchill Downs meeting meetingHawthorn Hawthorn was shipped to Louisville this morning with his stablemates Douglas Park and the Cincinnati Trophy and Clipsettu Stakes at Latonia Smoke House is training well for Wallace The Widow Moon is also doing well and barring misliaps will lie a keen contender in the big filly race at the Downs 24The on the final day of the meeting May 24 The decision in yesterdays handicap at Lexing ¬ ton when Yankee Xotions and Kudolfo ran a dead heat and in which the purse was awarded to Ru dolfo uHjn thp refusal of II K Knapps trainer to let Yankee Notions run It olT was based on Xew York Jockey Club rules This rule was put in force in the cast in ISUo Heforo that time when a horse withdrew from a dead heat the remaining horse walked over and the bets followed the decision of the purse In other words the horse withdrawn lost all chance of winning and only shared in the place money in tho books In 1S in a race there Suisun and Burlesque ran a dead heat and M F Dwyer the owner of the former was credited will having wagered 000 on Snisiin It was charger that Dwyer to avert a run off and to win all his wagers paid the owner of linrlcsquc to withdraw that colt Under the existing rules there was no penalty attached to such a proceeding but later the Jockey Club next Friday the day before the great nice is run off McDuiiicIs reason for this is that the colt is doing so well at Lexington that he does not feel he can improve matters by coming hero early He has an idea that it is less risky to run him almost at once on his arrival here than to get him in a dny or two before the big race is decided McDaniel thinks he will hind Foundation here Fri ¬ day night rest him up breeze him Saturdny morning and win the Kentucky Derby that afternoon He is confident victoryWilliam of the colts victory William Gerst the Nashville turfman whose horses are in training at Douglas Park in charge of George Ham lias arrived to see the Derby and will be here off and on during tho entire local spring racing sea ¬ son Trainer Ham 1ms had ill luck with the Gerst horse 15 this spring They were nearly all sick early in the season at Xashville and it was only lately that he has got them rounded back to anything like perfect health and good training condition conditionJudge Judge C Price thinks lie lias been much im ¬ proved in health by his recent trip abroad in com ¬ pany witli Col M J Whin Ho was not sea sick going or coming and in all their jauiitsin tho differ ¬ ent countries they visited he seemed to be in no wise affected by the various changes of climate Judge Price looks upon Kentucky spring racing season prosperity as more than ordinarily rosy and he expects to sec a recordbreaking crowd at Churchill Downs on Derby day and at Douglas Park when the i000 Kentucky Handicap is decided
