TEST CASE TO SUPREME COURT. New Orleans. La.. June S. — Edwin Austin, tried befor Judge Fbury recently on a Charge of violating the Iocke law, was found guilty and sentenced lo pup a fine of .LOO and serve eight months in jail. The decision came Wednesday, but the court gave no written judgment. An appeal was taken. Austin was arrested at Suburban lark Saturday. May 19. when barn, ss races were run at a firemens picnic. The case is in the nature of a test of the Locke law and upon the Supreme Courts decision, it Is said, depends the future of horse racing in this city. Austin made and received l»-ts during the races and the defense coutends that he was engaged in individual betting, which is not prohibited by law.
