D J. LEABY RULED OFF. Saturday judges Bees and Euhl reached a conclusion in the investigation of D. J. Leary. trainer for Mr. John Brenock, and also in tbe case of John B. Beckley, trainer of the filly Oconee, protested for false registry. Their decisions are as follows : "September 15th, we suspended trainer D. J. Leary indefinitely pending investigation of the inconsistent running of the horse Lew Hopper. "SoDtembar 12th, in the third race of that day, distance one mile, weight 112 pounds, with jockey Vandusen up, he was off in front in a good start but commenced to drop back immediately until at the half-mile pole he was ninth in a field of eleven, and ten lengths ba-hind tbe leader. Under a vigorous ride the horse waa unable to improve his position and at the finish waa last by twenty lengths the race being won by Jackanapes, time 1:411. September 15th, in the fourth race of that day, distance one mile and a furlong, weight 107 pounds, with jockey Vititoe up, he was off in front in a good start and dropped back to second place, which position he retained until nearing tho stretch where he assumed the lead, which he rapidly increased and stopping at tbe finish, won by a head in 1:531, bjating Jackanapes eight lengths. In this race the track conditions were the same as in the previous race, but tho class of the horses finishing behind him much batter. "Trainer Lary said he was unable to offer any explanation as to the cause of the 6udden improvement in the" horse except that he carried less weight than in his race of September 12th. From evidence secured during our investigation, we are satisfied some drug or injection was used in his race of September 15th. The running of other horses under tho charge of Leary has not been above suspicion, and while we fully exonerate the stable, we are of the opinion that trainer D. J. Leary merits the most oxtremo punishment. In accordance with the rules governing same, he stauas ruled off the tnrf. September 15 we suspended John R. Beckley, owner, and the stable connections, also the filly Oconee, pending investigation of the inconsistent running of the filly September 7, 12, and 15 respectively. September 16 Mr. E. W. Purser, owner of the colt Tarhill, protested tbe payment of firat money won by the filly Oconee September 15 on the ground of improper registration. "We find that John R. Beckley, who was recently in the employ of jockey J. Everett as valet, waa in fnll charge and control of the filly Oconee on tbe dates in question, in the capacity of trainer, with a winning percentage, and is in every sense responsible for her races, and in a manner for tho improper registration, as evidenced by the registration attached herewith. The stable connections contradict in a manner, and leave a reasonable doubt as to their responsibility in any way, and are exonerated I accordingly. In accordance with our observations and other evidence attained, we recommend to the License Committee of the American Turf Congress that the license of John R. Beckl y as trainer be revoked forthwith. j For violation of rule No. 70. as provided, I the filly Oconee is dibqualiHod for first money won September 15, in tho eoiond race of that I day.
