Tho Committee on Appeals has rendered the following opinions, viz: "In the case of L. H. Ezell against tho Harlem Jockey Club, we are of tho opinion that Rule No. 26 was complied with. The rule does not contemplate that the complainant shall, in person, give notice within five days. We hold that ho may in person, by an attorney, or other authorized person, give the notice. In what more official way could he give notice than through the Secretary of the, Committee on Appeals? Hence the claim of the Harlem Jockey Club that Mr. Ezell could have no standing before tho committee is untenable. So far as those papers show the decision of the club that tho race was no contest is erroneous, and the purse should be paid to the proper parties."
