DECISION IS AGAINST BUTLER. James Butler, in his effort to have the Supreme Court of New left Miipi I the State Racing Commission to grant a license to the Fmpiro City Track at lonkers by mandamus writ, has lost out. Justice Mills of the Supreme Court has decided the ca-e lo the favor of the State Racing Commission, sustain mg the contention of the Couunis-ion that under the law of the state it has absolute power in the matter of granting licenses. Mr. Battel may. of course. appeal the case, bill it is hardly likely that he can secure a decision until late in the year. So, even should the higher court reverse the decision of Justice Mills, it would be to late for a meeting at the Youkeis track this year.
