DRASTIC ACTION AGAINST LAT0NIA REBELS. State Racing Commission Withdraws License, but Will Grant New One on Named Conditions. Lexington. Ky.. October 20. At the conclusion of the meeting of the State Racing Commission held here today, with all members present except Charles F. Grainger of Louisville, and before which Harvey Myers, representing the Latonia Jockey Club, had appeared. Secretary Arthur Rouse gave out the following: "For a violation of one of the rules of this commission, which reads. All racing associations licensed by this commission are hereby instructed to permit only the pari-mutuel system of betting and the auction ikriIs on their grounds, and any violation of this rule will le punished by a revocation of their license. the license granted to the Latonia Jockey Club for the year 100S is hereby revoked, to take effect at one oclock Tuesday. October 20. IOCS, for the reason that this commission believes the continuance of such licensed meeting with the system of book bettiti". at present conducted at Latonia. is not conducive to the best interests of legitimate racing, and that great harm to legitimate racing will ensue if such system of betting is continued." When the session opened Secretary Rouse, under instructions from Chairman Chinn, made his report to the effect that bookmaking with hand slates was in vogue at Latonia yesterday on the opening day of the fall meeting, that no pari-mutuel machines were in operation and that no auction iwols were sold. The presence of Attorney Myers was announced with n request from him for a hearing. Mr. Myers explained the svstem of betting which was used yesterday, reported that the directors had also decided to nut on mutuel machines in conjunction with the books, lieginning today, and asked that the commission agree to the continuance of mutuels and books jointly and agree to a test of the right of the commission to specify the form of betting and .suspend any contemplated action until a decision of the courts could be had on the question. The four commissioners then went into executive session and formulated their resolution as above. At 1:03 oclock they called Mr. Myers into the room and advised him that thov had revoked the license of the Latonia Jockey Club, but that if the directors of the club would agree to live up to the rules of the commission a new license would be issued tomorrow. Mr. Myers said lie would return to Cincinnati and place the matter before thedirect-ors of the club tonight. The commission adjourned to meet again tomorrow morning at 11:30 oclock, when it is expected the Latonia Jockey Club will announce its decision to continue the meeting under the rules of the commission and make application for a new license, or declare off the meeting entirely. None of the commissioners who were here today expect the club will decide to continue the meeting with book betting. If they should, however, it is almost certain that the track will he closed by Governor Wilson. The purpose of the commission in fixing tho exact time for the revocation to take effect today, was to forestall the possibility of any court order restraining them from revoking the license. W. J. Young has brought all his horses to the local track and is now devoting his attention to his yearlings. He says he heard that Hot Springs will bo on tho racing map again next winter and it is his intention to go to Memphis some time in December to get his racers ready. Colonel Jack Chinn said today that the story sent out of Frankfort to the effect that ho intends to make a try for the Mexican Derby in 1010 Is all rot. "I shipped a carload of cast-offs down there." he said, and they were sold as soon as they were unloaded." Edward Corrigan left here this afternoon for Chicago.
