DECISION FAVORS NEW YORK RACING. New York. May 7. — Retting without writing or recording is not Imokmaking. is a decision of the Appellate Division of the New York State Supreme 1 "Hit rendered today in sustaining the writ of babes* corpus. The district attorney of Kings and S il I.ielitenstein. These men were arrested at the race tracks last summer on charge- of violating the penal code by baokmukfug. but were released bv habeas corpus. Tic district attorney of Kings County appealed from this decision, lull the Aupol late Division sustained the lower courts. The court 1 ■fused to sustain the content ion of the prosecution that hookmakiiig was the making of a plan of odds to be followed in betting; which was not necessarily recorded but could Ik- iinimicated orally. This decision, while only sustaining a decision previously made, is pleasing to the authorities of the New York tracks and is hold to lie of valuable assistance in conducing to the success of this years racing.
