C. J. Fitzgerald and William Engeman. who were indicted as common gamblers. Assistant District Attorney Elder, of King- County. argued that tin sc indictments should stand. Counsel for the accused urged that there was no possible ground upon Which thev could be punished. The case has been carried through the lower courts. All have held that neither of the defendants has broken Unlaw.
