STATUS OF THE JAMESTOWN CASE. Norfolk, Va., September 23. That the fall i-aces of the Jamestown Jockey Club will be run in November as scheduled was practically assured when the quo warranto proceedings brought in the name of the commonwealth of Virginia against the Jockey Club for annulment of its charter on the ground of statute violations went over until the October term of court. The charter annulment proceedings cannot be called again until October 23. The races are scheduled for November and will be concluded before the action by the commonwealth Instigated by Governor Mann through the olfice of "the attorney general can be brought to a final issue, even should the case be forced ty trial at the October term. With an adverse verdict in October or early In November, the Jamestown Jockey Club would appeal, and a suspending order to allow for perfection of its appeal to the supreme court of Virginia would be in force until the races are ended. Judge B. D. White of the circuit court of Princess Anne county, presided in the Norfolk City circuit court, where the case is pending, in the absence in EuroiKs of Judge McLomore. Governor Mann had named Judge AVest of Sussex to preside at the trial of the race track case at this term of court, but Judge West was not to have come to Norfolk until the date upon which the proceedings come up on their merits. The continuance of the case was because of the absence In Europe of leading counsel for the Jamestown Jockey Club.
