JURY HOPELESSLY DIVIDED STATE FAILS TO MAKE GOOD ITS CASE AGAINST JAMESTOWN JOCKEY CLUB. Special Justice Appointed by Governor Dismisses tho Proceedings When Verdict Appears Impossible Majority of Jury Favors Club. Norfolk, Vn., November 2S. After deliberating fjr two hours the jury in the case of the State of irginia against the Jamestown Jockey Club, seeking a revocation of its charter on the ground ti,at ganl. bling is permitted at the track, reported at 11 oclock last night that it could not agree and was dismissed by Judge James L. West. The jury twica before during its deliberations sent word to the court that there was no likelihood of an agreement, but Judge West sent it back to" trv again. When another message was sent the court shortly before 11 oclock that the jury was hopelessly divided, the Judge discharged it and adjourned court for thu term. Judge West said after court adjourned that there would not be another trial unless Governor Mann, who was the instigator in the proceedings, saw fit to have the case gone all over again. The jury stood seven to five in favor of permitting the Jockey Club to retain its charter. It rests with Governor Manu to say whether there Fhall be a .second trial of the commonwealths prosecution. That there will be no further trouble from the authorities is the general opinion, at all events not this fall, as the racing season ends here on Thursday. Governor Mann said this morning that lie would take no further action in the case until he had a consultation with Assistant States Attorney General It. B. Davis.
