DISCUSSING NEW YORK LAW There is no law against horse racing In this state said a prominent attorney yesterday and if one of the tracks should be leased by a corporation composed of fearless men It would not take long to find out the constitutionality of the socalled directors liability law Before a director of such a corporation could be prosecuted it would first be necessary to convict a person of the alleged crime of bookmaking without writing Then it would be time to indict a director for allowing a violation of the law without his knowledge or consent From a legal point of view I believe that a conviction under the directors liability law would be impossible and that the courts would declare the statute uncon stltutional Such a decision would permit racing without Interference except in so far as the present laws relate to bookmaking It is a matter of record that the courts have never pronounced betting a violation of the criminal law A line can easily be drawn between betting and bookmaking New York Sun
