LATONIA S LICENSE CASE CONTINUED. Covington, Ky., October 17. When the case of the city of Covington against the Latonia Agricultural Association, to compel the payment of a license fee of 00 for each race run at the Latonia track, was presented to Judge Edmons, in police court, a motion of acting city solicitor John Richmond that the facts be presented to the court in briefs was sustained. The case was continued until October 21. Attorney Harvey Myers, representing the race track, was accompanied in court by General Manager John Hachmeister and Secretary Frank J. Bruen. Facts as to the manner of running races and jurisdiction of the city to assess a license fee will be presented to the court in the briefs. Opposing attorneys were unable to agree on the law governing the case. Manager Hachmeister took occasion to point to numerous improvements which have been kept up in Latonia by the race track officials. Attorney Myers questioned the right of the city to pass the ordinance, and declared the more the track officials do for the city the worse they are treated. If the city were to recover 00 for each race run at Latonia during the present meeting, which lasts nineteen days, the racing association would be required to pay to the city treasurer 3,300. Safety Director Kluemper was instructed by the city solicitor to continue citing the track officials daily for failure to pay the license.
