FAIR GROUNDS CASE ONLY REMANDED. Supreme Court Decision in No Wise Affects Present Situation at New Orleans. In connection with the decision of the Supremo Court refusing the rehearing of the case of Hiss Jean Gordon against the Business Mens Racing A-sociation. Joint I. Sullivan, attorney for the association, said last night: "In the lower court, exceptions of no cause of action and no right of action and a plea of estoppel were filed. Judge Skinner maintained the plea of no cause of action and no right of action, but did not pass on the plea of estoppel. Be stated in his opinion it was aaaeeessary to do so. having dismissed the case on the no cause of action and the no right of action exceptions. The Supreme Court has simply reversed the decision of Judge Skinner, and dismissed the exception of no cause of action and no right of action and has refused to rehear same, but in doing so has remanded the case back to Judge Skinner to pass on the plea of estoppel.
