MARYLAND TURF CONTROL Placed in Hands of Newly Created State Racing Commission Stuart Oliver J P Kennedy and andE E C Timanus Appointed by byGovernor Governor Richie RALTIMORE Md July 23 Governor Ritchie has appointed tlio first racing commission that will supervise all racing fix and make rules governing the sport in Maryland under the pro ¬ vision of the Burke law enacted at the last session of the legislature The commission will be made up of Stuart Oliver publisher of the Evening News Joseph P Kennedy of the Kennedy Foundry Company and E Clay Timanus former mayor of Baltimore City Stuart Oliver has been named as chairman of the commission and J Ferd Hayward a newspaper man secretary to the board boardThe The Burke law for the government of racing in Maryland is an exceedingly drastic and compre ¬ hensive measure It provides for the appointment of a Maryland racing commission of three members who shall be appointed by the governor the chairman to receive 4000 salary per annum and the other two members 3000 each with a limitation of 20000 of its annual expenses other than these salaries It is the extraordinary super ¬ visory executive and even punitive powers vested in this commission that is the quite remarkable feature of the law This is set forth in the follow ¬ ing excerpt 11 Said racing commission shall have full pojyeJX to prescribe rules regulations and conditions under which all horse races shall be conducted within the State of Maryland Said commission may make rules governing restricting or regulat ¬ ing betting on such races and may fix or regulate the rate of charge by the licenses for admission or for the performance of any service or the sale of any article on the premises of such licensee and may regulate the size of the nurse stake or award to be offered for the conduct of sucii races racesAll All contracts and agreements for the payment of money and all salaries fees and compensation paid by any person or persons association or cor ¬ poration licensed as hereinbefore provided and all proposed extensions additions or improvements to the buildings stables improvements or tracks upon property owned or leased by such licensee shall be subject to the approval of the commission Said commission shall have power to compel the produc ¬ tion of any and all books memoranda or documents showing the receipts and disbusements of any per son corporation or association licensed under the prbvisions of this act to conduct race meetings meetingsCONTROL CONTROL OVER EMPLOYES AND OFFICIALS OFFICIALSThe The commission may at any time require the removal of any employe or official employed by any licensee hereiinder The commission shall also have the power to require that the books and financial or other statements of any person corporation or association lincensed under the provisions of this act shall be kept in any manner which to the com ¬ mission may seem best and that the commission shall also be authorized to visit to investigate and to place expert accountants and such other persons as it may deem necessary in the ollices tracks or places of business of any such person corporation or association for the purpose of satisfying itself that the commissions rules and regulations are strictly complied with and the salaries and ex ¬ penses of such expert accountants or other person corporation or association to whom they are as ¬ signed signedThe The said commission shall have power to sum ¬ mon witnesses before it and to administer oaths or affirmations to such witnesses wb ncvr in the judgment of the said commission it may be nec ¬ essary for the effectual discharge of their duties and any person failing to appear before said cim mission at the time and place specified in answer to said summons or refusing to testify shall be deemed guilty of a misdemeanor and upon indict ¬ ment and conviction in a court of competent juris ¬ diction shall be punishable by a fine if not more than ii000 or by sentence to jail for not more than six months or by sentence to both line and im ¬ prisonment in the judgment of the court False swearing on the part of any witnesses uliall be deemed perjury and shall be punished as srch srchOther Other provisions call for a license fee of 0000 per day to be paid before the issuance of n license to race In addition the state exacts fifteen per cent of each racing associations net revenue As the bill was drawn it called for 112 racing days for the major organizations An amendment cut the number to 100 Fairs may be licensed to conduct racing for five days at a fee of 50 per day The Agricultural and Mechanical Association of Wash ¬ ington County may have two meetings of five days each However the heart of the proposed new law is in the sections quoted
