WEST VIRGINIA LEGISLATION DEFECTIVE. . Charleston. W. Va., March 7. It transpires that the anti-poolroom 1UU which Governor Glasscock permitted to become law without his signature may-be ineffectual in accomplishing . the purpose , for which it was intended. The bill was aimed against a poolroom operated at Wheeling and licensed under the special legislative act granting that city a charter.- Iu attempting to exclude county fairs from its provisions, the bill was amended in the legislature aud the principal verbs in the first part, where a poolroom is defined as any room where certain tickets are sold, were left out. The phrase omitted inadvertently is "is sold or offered for sale." The bill as it became a law is as follows: "That Section 10 of Chapter 151 of the Code of AVest Airginia he aud the same is hereby amended and re-enacted so as to read as follows: "10 The word poolroom wherever the same is used in this section shall be held and construed to mean any room where any iwol ticket, chance, voucher, or certificate entitling or purporting to entitle the holder of promises thereof or any other person, to money or other thing of value, contingent upon the result of any horse race, prizefight, game of chance, game of skill or science, or other siKrt or" contest, the information of which result is obtained by telegraph, telephone, wireless telegraphy, or other electric device. "Any person who shall set up or promote, or be connected with or interested in. the management or operation of, any poolroom; and any person engaged in the telegraph, telephone or .wireless telegraphy business, his servants, agents or employees, who shall transmit of finish, or permit to bo transmitted or furnished, over or upon, or by means of, the wires, lines, apparatus or appliances thereof, to any poolroom, or to any person, to be used at or In connection with any poolroom, any message, token.or information, or concerning the result of any such event as in this section mentioned; they and each of them shall be gulltv of a misdemeanor, aud upon conviction thereof shall be fined hot less than 00 nor more than ,000 for each offense, and may at the discretion of the couit .be confined in jail not to exceed one year. "The buying, selling or transferring of tickets or .chances in any lottery . shall bo and the same is hereby prohibited. .... "All acts and parts of acts inconsistent with this act are hereby repealed."
