TEST CASE IN NEW YORK STATE. Court of Appeals Hears Argument on Appeal from Conviction in Betting Case. ft Albany N. Y., December 14. The appeal of Michael Lambrix from a judgment of conviction rin the Brie County Court for placing a Itet on a horse race for which he was sentenced to the penitentiary for a term of six months, came up for argument in the Court of Appeals here yesterday. Lambrix was an engineer at the White Elephant Hotel, Buffalo, N. Y., and was charged with having made a bet with George S. Green, a police detective, on a horse known as Arondaclc. which was entered and running at Jacksonville. Fla. The name of the horse was selected from a Buffalo newspaiicr. It was not alleged that Lambrix was acting as a bookmaker or was the owner of a poolroom or "gambling" apparatus. The decision will determine whether the placing of such a wager between individuals is a violation of the law, and will determine one phase of the Uart-Aguew and Agncw-Perkius laws.
