HAS NO STANDING IN COURT New York April 12 Patrick J Murphy a resi ¬ dent of Long Island City who when the race tracks wero running hereabouts was known at all of them as a bookmaker and layer of odds told Justice Benedict in the Queen County Supreme Court how ho won 200000 for himself and Mrs Vitoliun Foulkc his backer who formerly was a resident of New York City but who now is living in Montreal The testimony was given in a suit which Murphy brought to recover 2VO from Mrs Foulkc whicil he alleged was the remainder of the profits due him himMrs Mrs Foulke furnished the money for me to carry on my operations testified Murphy In one year I cleaned up 00000 Mrs Foulke accom ¬ panied me to the race tracks at Baltimore Washing ¬ ton Cliftcn Monmonth Park Jamaica Gravesend Aqueduct and Relmont Park Whatever I made every day was divided equally between us I did not take all the money due me I was a liberil spender and Mrs Foulke kept part of my money mvi so I would not spend it Carlylo Norwood Mrs Foulkes attorney to dismiss the moved suit and Justice Benedict tho motion on tho ground that it aJti granted tirecover was an on ti recover the profits from gambling opera t WM prollibitcd b no suit could l
