ASKS CONTROL OF EXPIRE CITY TRACK. John F. Rrennan. representing James Butler, owner of the Empire City rai-e track, made a motion Wednesday for possession of the Empire City race course, which was awarded to the Empire City Association by a verdict of a jurv in the Supreme Court, which decided that the National Fair and Ex|Hisition Association had broken its lease. Lee P. Ihivis. appearing for tlie National directors, opposed the motion and asked for a stay of execution for thirty days, as he said the defendants intended to appeal from the ejectment verdict to the Appellate Division. Justice Morschauser directed that briefs be submitted. It is believed that a receiver will be appointed to take possession of the track lending the determination of an appeal and this will enable the Empire City Racing Association to have running races next year.
