SUIT AGAINST KENTUCKY ASSOCIATION Action Is Instituted Against Owners of Lexington Track for Back Taxes TaxesLexington Lexington Ky July 17 Walton M Byars reve ¬ nue agent for the state at large a resident of Louis ¬ ville yesterday filed suit in tho Fayetto County court against the Kentucky Trotting Horse Breeders Association and tho Kentucky Association owners of the two race tracks here for back taxes for five years The aggregate per year listed against the former organization in the schedule filed by tho petitioner is 112000 of which the largest item is 8 000 which is expressed as franchise not al ¬ lowed by law maintaining and operating betting pools poolsTho Tho suit against the Kentucky Association is for taxes on 129800 the largest item being 95000 expressed as maintaining and operating betting pools and leasing privileges of same sameAnother Another item in this suit is 7000 alleged to have been received from contracts for furnishing form sheets various pool rooms and Western Union data as racing information informationSince Since it is lawful to wager on horse races at tracks during race meetings in this state and since the state exacts a license per days for the operation of those meetings with betting which amounts to a franchise tax it Is difficult to understand just what the revenue agent is undertaking to present in the largest items in his suit suitThe The taxing authorities heretofore have held that the Kentucky Trotting Horse Breeders Association is not liable for a franchise tax To those who know the affairs of the Kentucky Association as well as most business people hereabouts do the 7000 item in the schedule is absurd Tho State Racing Commission laws expressly forbid the sals and dissemination of racing information to pool rooms or handbooks and the law is not violated No charge is made to newspapers for the privilege of making form sheets
