MARYLAND CASE TO COURTS Row Over Racing Commissions Surrender of License Power Await Attorney Generals Opinion OpinionBefore Before Such Action Will WillBe Be Taken BALTIMORE Md March IS The fight over the Racing Commission to surrender its license IMWPT to outside associations is likely to be carried to the courts for settlement settlementThis This is indicated by president Win I Norris of the state senate who as counsel in the jockey Carroll H Shilling case has taken a leading part in the racing rules controversy Senator Norris said he is considering asking the courts for a damns to compel the Racing Commission to rules for licensing trainers and jockeys on tho ground that such rules are required by the law which provides that the commission shall control ami regulate racing in the state stateSenator Senator Norris saw Attorney General Armstrong as did racing commissioner E Clay Timanus who voiced a minority support in favor of the adoption of licensing rules Mr Armstrong now has before him the requests for opinion of the rules rulesThe The first of these is from the majority members of the commission Stuart Oliver and Joseph P Kennedy asking for a general opinion on the legality of all the rules and for a specific opinion on the legality of the method proposed for naming track stewards stewardsMr Mr Timanus who fought for the licensing rules not under the law the commission is compelled to adopt licensing rules for trainers and jockeys jockeysIf If the matter is brought to court by Senator Norris it probably will not be until after Mr Arm ¬ strong renders his opinion It is generally believed that if thrashed out by the courts the rules con ¬ troversy will bring out some interesting and even sensational disclosures relative to the system of some of the members of the New York Jockey Club in handling jockeys and trainers
