i AWARD PETTENGILL 10000 Surrogate Rules that Wifes Bequest to Non NonExistent Existent Institution Is Void NEW YORK N A February 25 Surro ¬ gate Foley decided last AVednesday the 10 000 bequeathed by Mrs Charles IT Petten gill to an institution for the blind and crippled at Oil City Pa was void voidInvestigation Investigation by Charles IT Pettengill her husband revealed there was no institution in Oil City caring for the blind and crippled Inasmuch as there was no residuary clause in Mrs Pettengills will Surrogate Foley ruled the 10000 would have to be admin ¬ istered as if Mrs Pettengill had died intes ¬ tate The bulk of the 10000 will go to Mr Pettengill Other provisions are not affected Mr Pettengill was one of the placing judges at the New Aork race tracks for many years previous to 1921 when he re ¬ tired
