TO TEST SALT LAKE CITY ORDINANCE. Salt Lake City. Utah. July 17.— Judge George C. An.istriiig has issued a Wilt of prohibition return-ahie July 20 restraining Judge J. M. I low man of the criminal division of the city court from assuming jurisdiction in the trial of the case against EL .1. Carrigan, charged with violation of a city ordinance through tbe alleged maintenance of a l»ol foe hotting on horse races in the roar of 225 South Main street, this city. favrigan was arrested by patrolman R. A. Iladka June 27. and a complaint was tiled charging him With gambling. arrigan riled a demurrer to the complaint oat the ground that the complaint was not in aceordance witli the requirements of the state law. and that the city court had no jurisdiction in the matter. The demurrer was overruled and trial ■et. Sotting forth that he might be convicted at the trial if it were held, and on the ground that the city Judge was without jurisdiction in the case, Carrigan applied to the Third District Court for a writ of prohibition restraining Judge Bowman continuing with the trial. Carrigan alleges that the city judge is without legal Jurisdiction in the matter. as tin- oily bad not tbe right to pass, the ordinance Under which he was arrested and the complaint Issued. Ike ease is owe of considerable interest, as ii involves the question of the authority of Salt 1 ake City in the niattrr of race track booking. Which lias been questioned before. This is tbe first time that legal stops have been taken to tost the city ordinaneos. ieiause of the ordinance referred to racing with betting was abandoned by the Utah Jockey Club at poena Vista Talk, which is within the city limits. Lagoon Dark, where racing was recently conducted, is out of the jurisdiction of the city.
