NO RACING FOR SARATOGA BAN EXTENDS EVEN TO THREE DAYS HUNT CLUB MEETING THAT WAS PROPOSED. James Butler Hopes to See American Turf on Samo Footing As in France Apportionment Act Upheld Futurity Declared Off. New York, July 27. Positive denial is made of the report that there will be a. three days hunt meeting at-Saratoga. There are various reasons foe not giving a meeting. The principal one is that while the existing law is on the statute books no attempt will bo made to arrange any sort of a program. It was further stated by one of the executives of the Saratoga Association that it would not be worth while to prepare the big course for a, meeting of such short duration. James Butler of the Empire City Racing Association in making his denial of the published rumor concerning a regular race meeting at the Yonkera track said: "Theres not a whit of truth in the statement. I have never given such a proposition a single thought, und even if the thing was possible the Jockey Club would announce the fact. Like many others who are interested in horse racing for the sport and the pleasure of its pursuit, I had my hopes sorely dashed when the Gittins bill failed to pass. But I am convinced the day is not far distant when horse racing in Now York State will be on the same footing it now is in France. Its a sad disappointment that wo will bo unable to race at the Empire City track this fall. We were all ready for a grand opening, and some time I hope we will be able to hold it. "If racing had been resumed this fall the breedera of the country would have been encouraged to resume their occupations, and the managers of the tracks would have been given ample chance to decide just how large purses they might be able to offer the owners next season." Believes Liability Law Unconstitutional. Albany, N. Y., July 27. State Senator Brackett of Saratoga; who was a warm supporter of the Gittins bill, has written a letter in which he explains that lie voted for the race track measure not because lie believed In gambling, but because ho had been assured by tho officials oe tho Saratoga Association for the Improvement of the Breed of Horses that no gambling would be permitted at tho track, and also because his fellow townsmen wanted a race meeting. He does not believe the Gittins amendment was needed because the directors liability law is unconstitutional. , Reapportionment Aot Is Upheld. Albany, N. Y.. July 27. The constitutionality ot the legislative reapportionment act passed at tho extraordinary session of the Legislature in 1907 was upheld In the Court of Appeals in a unanimous decision today. The validity of tho Hart-Agnew anti-race track gambling laws was indirectly involved in the actions, three in number, which were heard. It was claimed by the racing interests that if tho reapportionment act was set aside the Hart-Agnew laws were unconstitutional on the ground that they were passed by a Legislature elected by an illegal apportionments Some of the Democratic leaders also were hopeful that the apportionment law would be declared illegal so that the present Democratic; Legislature could pass such a measure. Futurity Is Declared Off. New York. July 27. The Futurity, the richest raco of the American turf, will not be run this year. The directors of the Coney Island Jockey Club met on Tuesday and decided to take this action. Thn secretary was instructed to return all of the entrance, money made by the nominators. Had Senator Git-tins racing bills been passed it was the intention of the club to run the race at Saratoga. Today official notice of the Coney Island Jockey Clubc action was mailed to those still having entries in the Futurity. There- were seventy-two ellgibles. Whether there will over again be another Futurity depends upon legislation. This famous race, first rim in 18S8. was for years the most valuable in the world, being worth as much as 1911.sh7,075 to the winner iu 1S90. Iu 1010 its value shrank to 5,300.
