1 , i J, i * j i t ! a i i , ! GRANTED STAY IN EMPIRE CITY CASE. I National Fair and Exposition Association to Prosecute Its Appeal. White Plains, N. Y., December 12.— Justice Morschauser has granted a stay of execution of the judgment evicting the National Fair and Exposition Association from the Empire City race track pending an appeal by tbe National Association to tbe appellate division. Counsel for James Butler and the Empire Association asked that the National directors give a bond for 00,000 to cover the loss of the use of the track and expenses in general. It is reported that if the bond is not given the Empire City Association will get possession of the track upon giving bond to protect the National Association, should it win on the appeal. Counsel for Mr. Butler says that if tbe National Association is continued in possession of the track running races cannot be held there next spring. Justice Morschauser allowed counsel for the Empire City Racing Association an extra allowance of ,000 and a full bill of costs.
