MixUp in Sale of Two As Yearlings in Court CourtSeek Seek to Collect Damages From Walter Wells Breeders jGroup jGroupLOS LOS ANGELES Cal May 22 The mix up over the identity of two sons of Firozo pore sold as yearlings at the vendue of the California Thoroughbred Breeders Associa ¬ tion on July 15 1946 reached the courts yesterday when two damage suits filed by Irvin Stauffer market operator and Albert S Rogell film director the purchasers of one and Jack D Rogers buyer of the other against Walter G Wells breeder and the breeders association went on trial before Los Angeles County Superior Judge William J Palmer PalmerAlthough Although the colts are now three years old neither has been allowed to start in a race because their descriptions as regis ¬ tered with The Jockey Club do not fit the horses as individuals individualsIn In some as yet unexplained manner their identities became confused and the registered description bf the son of Easy Sailing is actually the description of the colt out of High Flight and vice versa The Easy Sailing colt now called Spokane was purchased by Sitauffer and Rogell for 6750 and they are asking for rescission of the sales contract and damages totaling 19000 19000Rogers Rogers who purchased the High Flight colt for 11000 is asking for return of the purchase price plus damages of 5000 5000Both Both purchasers contend that they now have the horses whichthey examined and bought at the sale and that the confusion was caused by either a mixup of registra ¬ tion cards or a mistake in identification of the two horses prior to the sale
