SUNSHINE HELPS LATONIA PLEASANT WEATHER INDUCES INCREASED ATTENDANCE AND INTEREST. Berwick - Braces Up and Defeats Fast Sprinters Grande Damo Continues to Win Progress in the Review Case. Cincinnati. The weather, which liad turned out mild after the miniature blizzard of the last two days and a convenient increased attendance were incidents which made the sport at Iitonia today the most satisfactory of the week. TJi speculation showed marked improvement, a fact siOpreeiated by the fourteen layers who catered to the wants of the public in that line. The card was si good one. but the racing was hardly up to the average in some of its features. Two of these were the defeats of the heavily backed odds-011 choices. Alice Baird and Alma Dufour. The former ran below her best form, while Alma Dufour had no chance whatever after the start, as she was turned around at the barrier and practically left at the post. T. C. McDowells bisr sprinter. Berwick, eame into uls.owu again in winning the feature ram a handicap at three-quarters, in which some of the speediest sprinters of all ages located in this section were starters. Anticipating that Berwick would show to better advantage because of the strong rider in the middle, the public installed him favorite. Hanbiidge nud Ethon. however, had a host of supporters, while painty Dame and Marse Abe did not laek a following. Berwick began faster than formerly and followed Dainty Dame closely until on the stretch turn, where he dashed by Imr to win rather easily. Dainty Dame held out lone enough to outstay Ethon. Ilan-brldge ran gamely but was not dangerous under ins heavy impost. For some reason Mrs. Sewall. despite her victory yesterday, was entirely neglected and upset the wise nooplos calculations by romping home an easy winner over twelve other if airly good class youngsters that started in the opening race. Jockey Lovell was originally carded to ride the filly, but the iudges ordered him taken down and substituted Griffin. Floreals sudden improvement in taking the second race from Dispute and Alice Baird. the choices, remitted in little profit to the layers, who were called on to pay out liberal sums to a smart set who had anticipated her victory. An unavoidable jam occurred soon after the start in the seven furlongs race, third on the card, which aided George Ilendries Grande Dame to score her third -successive victory. .She was lucky in escaping the Interference and easily wore Lady Anne down I to come away a comfortable winner in the stretch. The showing of Sorrel Top. which finished second, was a good one. Aimee C. did well to finish third after the rough usage she was subjected to. Jockey Doverichs incompetency accounted for Alma Dufour being practically left, at the post in the closing race, for which she was a well-backed favorite. At the start the mare attempted to wheel and Deverich, becoming rattled, pulled on the wrong line, getting tangled with Besterling and .causing the latter also to have much the worst of the start. The bad send-off effectively disposed of Alma Du-fours chance of winning and. by finishing third to Lady Baldur and Braucas. she clearlv showed that, with an even break, she would have won. An early advantage secured bv Deacon at the start m the fifth race assured his victory, as he, led by a Rood margin all the way and was never in danger of defeat. Martius and Mortilov taking the minor portions of the purse in advance of Itobin Hood, the favorite. The latter, in addition to being stilt and sore when going to the post, hail a rough trip throughout. Arguments were continued today in Judge Harle-sons court in Covington in the pending action of the Latonia Jockey Club against the Kentucky State Racing Commission. Harvey Myers appearing for the plaintiff and Judge Lewis MeQuown for the defendants. Yesterday Mr. Myers filed affidavits from the following owners and breeders: T. C. McDowell. W. E. Oots. P. Dunne. T. P. Hayes and J. T. Ireland. Should the court overrule the commissions demurrer to the plaintiffs petition. these affidavits will furnish the evidence on which the matter will go before the court for final adjudication. Thev state that the "rules, regulations and conditions" prescribed by the commission relate entirely to such details as the arrangement of stake and purse conditions, the regulation of jockeys, etc. and that thev have nothing to do with betting on race tracks. The affidavits also state that the public does not patronize the pari-mutuel system of betting to anv extent, lint will and does patronize betting bv the book-making system, and that racing associations cannot exist in Kentucky and give reasonable purses except under the bookniaking system of speculation. The final action of the court will probably be delayed home days. Consignments from T. O. McDowell, L-. A. Cella and P. Kernells stables will be offered in the Haddock by auction before the racing tomorrow. The horses of E. It. Bradley. Albert Simons. S. W. Streett and J. H. McCormick are due to arrive here tomorrow. It is expected Unit several jockeys, including Joe Notter. will be here on Monday next and join the riding brigade. Charley Bowmans string of racers, most of which 3iave been ailing, are reported to be sufficiently recovered to stand shipment to California 011 Sunday next. II. R. Baker and Mose Goldblatt -are the latest owners to announce their intention to ship their horses to the coast. Fred Cook, who was an arrival today, stated that it would be three weeks before his departure for California. Negotiations are at present pending letween J. W. Mar and B. R. Ryan for the transfer of Miss Sain. The price asked is said to be ,000.
