KENTUCKY RACING COMMISSION TO MEET. Lexington. Ky.. May 4. — There will lie a meeting of the State Racing Commission in Frankfort Thursday morning. Mcmliers of the commission will go to Frankfort primarily for the purpose of hearing oral arguments before the Court of Appeals in the case of the Latonia Jockey Club vs. the State Racing Commission, which was decided adversely to the commission by Judge Matt Harbeson in the Kenton Circuit Court at Covington in Marth. A big dele gation of breeders and horsemen, including many who are interested in the light harness horse, will be present to hear the argument. At its meeting the commission will pass upon a number of applications for license, including that of jockey George Moun-taiu. It is practically certain that Mountain will get. a license, but his ridiug is likely to he restricted to tlie horses in the stable of W. H. Fizer. to whom he is under contract. In the Circuit Court here this afternoon. John W. Gates, of New York, filed suit against Edward Corri-gan for the collection of 6,152 and interest from March 27 to date, which he alleges is a remainder due him on a note of 8,500 given by Mr. Cor-rigan for a loan of that amount on March 2 ". 1008. and secured by 4S5 shares of the capital stock of tlie New Orleans Jockey Club. The plaintiff alleges that the note was for sixty days and that it was part of the agreement that if the obligation was not discharged at that time he could sell the stock, either publicly or privately and apply the proceeds on the loan. Plaintiff savs he sold the 485 shares of stock at public ami ion in New York February 1. lOoO. and that thev realized ,548. which is deducted from the lo.ni. In behalf of Mr. Gates, the Fidelity ami Deposit Company of Mary land furnished a bond of 3,000 and a general order of attachment was taken against the property of Mr. Corrigan to secure judgment.
