CALIFORNIA LAW TO BE ATTACKED. Arrest Made at San Francisco That Will Furnish Test of Anti-Betting Measure. San Francisco. Cal.. June 8. — A case that comes squarely within the provisions of the Walker-Otis anti-gambling act passed by the California legislature last winter has developed from the arrest of a young man named Charles Adams. The latter was standing on a street corner near police headquarters when two men started an argument on the relative merits of Ketchel and Inpke. who are scheduled to tight at Colma. July 5. The upshot was that one bet the other $." to .." and Adams was asked to act as stakeholder. It is alleged he consented and took the money. It appears that he was observed in the act by M. J. Troy, a collector. Troy immediately repaired to the office of the bond and warrant clerk and secured a complaint U| on which Iolice Judge Shortall. then holding court, issued a warrant for the arrest of Adams. The two men who hail made the bet meanwhile walked away, but Adams was found on the corner, placed under arrest and lacked up in the city prison in default of hail. Attorney Carroll Cook. who. some time ago, was retained by prominent sporting men to handle any cases arising from alleged violation of the new law. heard of the arrest and announced that he would defend Adams. Attorney Cook says that a test of the law will he made, as he is informed that the case contains all the elements necessary. Attorney Cook will apply for a writ of habeas corpus in order that the matter may be threshed out in the Superior Court. The question of the constitutionality of tin- law will Ik- raised. Attorney A. I*. Whelaii will appear as special prosecutor in the case.
