RESENT GOVERNORS ACTION INTERFERENCE WITH JAMESTOWN RACING FINDS NO SYMPATHY AT NORFOLK, Presiding Judge of Norfolk County Reported to Havo Snubbed tho Chief Executive When Latter Attempts to Dictate Assignment of Cases. Norfolk, Va., April 14. Magistrate J. S. Carmine will hear and decide the cases brought against Manager Bob Levy of the Jamestown Jockey Club and some half dozen of the layers at the Jamestown track growing out of indictments alleging violation of the Virginia aiiti-bookinaking statutes. The trials are scheduled for tomorrow evening in the county courthouse at Portsmouth. Judge Carmine resides in the same district an .Magistrate K. Q. Backus, who has twice decided that the laws of Virginia are not being violated at . the Jamestown track. The defendants under the Indictments include Bob Levy, general manager and promoter of the meeting; G. T. Miller, an alleged bookmaker and his clerk, William Ilickey; Joe Rose, I. Cohen, Rod Me.Mahon, L. C. Hall, the Jamestown Jockey Club and two John Does. The indictment charges Mr. Levy with being the lessee of a "shed in which betting In done against the dignity of the commonwealth" and the others are accused of violation of the autl-bctting laws of Virginia. Messrs. Miller and Ilickey were arrested twice before and on each occasion were dismissed, it being proved to tho satisfaction of Magistrate K. Q. Backus that the laws of the state were not violated. Governor Mann was n"t satisfied with the decision rendered by Judge Backus and he requested Judge Lawless, who is at the head of the Norfolk County judiciary, to name another magistrate to hear similar cases. The governor is said to havo requested Judge Lawless to appoint Allan C. Burrow special magistrate to hear the cases. Judge Lawless sent a reply to the governor in which he is reiwrted to have told the state executive that from a Judicial standiioint he could handle the situation in Norfolk County without interference from the state capital. Local -sentiment is overwhelmingly Willi Manager Levy leeuuse of his efforts to -provide Norfolk with good racing as an attraction and advertisement. Tin! sport provided at the Jamestown Jockey Clubs course this afternoon was the best up to date siifce the meeting began. Large fields went lo tiro, post in a majority of the races and the talent found the task of selecting Ihe winners a difficult one. The only successful favorite was Third Rail, which galloped home in advance of an ordinary lot in the-closing dash. The layers took liberties with Third Rail and a liberal price could always be obtained against him. He won with great ease, but his victory was a costly one for his owner. Hugh Penny, who was forced to pay 05 to win a purse worth ;f2lM to the winner, owing to a runup. The first serious accident of the meeting canio with the running of the opening race, in which a field of twelve went to the post. It was a dash of five and a half furlongs, the start being made on -a turn. E. Dugau, who had the mount on Black Branch, had an outside position aud when the barrier was sprung he Immediately cut across to the inside, with the result that three horses fell, one of which. Whin, was killed. Whin was the first to go down and Forester and Kcrran tumbled over her. The three riders. Adams. Connelly aud Bell, all came out of the mixup considerably hurt. Bell -was tho most fortunate of the lot in that he escaped with Hie muscles of an arm being badly wrenched and lorn. Adams had a foot crushed, while Connelly had one of his legs broken. Dugans offense. was so glaring that the stewards suspended him for the remainder of the meeting. J. Bergen, who rodo John Marrs in the same race, was also suspeuded. The improvement shown by Hoffman In the third race resulted in an order from the stewards which bars this horse from starting in future when the going is heavy. Hoffmans effort over a heavy track here a few days ago was decidedly poor, hence the ruliug. Nineteen layers operated this afternoon, winch was the largest number to date. If the verdict in the cases of the indicted men. -which will bo handed down tomorrow night, is favorable, there will be a big increase in the number of layers on Monday next.
