PROGRESS IN MONTANA TEST CASE. Butte, Mont., September 22. William Gemmell. secretary of the Butte Jockey Club, was arraigned in the district court yesterday on a charge of receiving and recording bets and entered a demurrer, contending that the information does not state facts sullieient to constitute a public offense. This action was taken according to the program mapped out for a test of the law limiting race track betting. Arguments on the demurrer will be beard and in all probability the decision or the district court will be appealed from, so that the supreme court may pass upou the sullicieucy of the law.
