BREEDING DISPUTE IN NEW ZEALAND. A dispute lias arisen in New Zealand as to who is tlie breeder of Castalia, winner of tin; Avontlale Stakes last month, and F. Hall, the present owner of the Marble Arch filly, claims to be entitled to the 2." allotted to her breeder. One of the conditions of the race referred to is that the breeder of the winner is to receive 25 out of the slake, and it is this clause that is now the subject of discussion. When Erry Roe was sold at auction by J. Hill she was stinted to Marble Arch, and foaled the filly now known as Castalia while in F. Halls possession. From Mr. Hills point of view, it is contended that having owned the mare at the time she was mated he has every right to lie considered the breeder of the foal, but, on the other baud, it is argued that once the inure changed ownership all such rights changed with her. A ruling is supposed to have been previously given in connection witli a similar matter in New Zealand, though no one seems to know where. There is. however, no room for misunderstanding on this point under the rules of the Australian Jockey Club, as an appendix to the conditions of the Australian Jockey Club Derby provides that "the owner of the dam of the winner at the date of foaling shall be deemed to be the breeder of the winner." This is the ruling generally adopted, but In connection with the case here referred to It Is more than likely that the matter will be referred to the New Zealand Racing Conference. Sydney Referee.
